Terms & Conditions of Sale
Woodpecker Garden Buildings is a trading name of CMP Carpentry Ltd, Company Number 10874395 VAT Number 313533240 Registered in England and Wales.
This document together with the other relevant documents, tell you the terms and conditions on which we supply any of the Products or services to you. Please read these terms and conditions carefully and make sure that you understand them.
The Contract
You should understand that by purchasing, you agree to be bound by these terms and conditions. Please understand that if you are unable to accept these terms and conditions, you will not be able to order any Items from us. Your order constitutes an offer to us to buy products and services linked to buying the Items. All orders are subject to acceptance by us, which we are free to accept or decline at our absolute discretion. We shall assign an order number to the Order and inform you of it in the Order Confirmation email. Please quote the order number in all subsequent correspondence with us relating to your purchase. We have the right to revise and amend these terms and conditions at any time.
Product Specification
Any photographs, samples, drawings, sizes and/or product description or advertising we issue, and any illustrations contained on our website are produced solely to provide you with an approximate idea of the Items they describe and/or are representative of the finished product. All goods are manufactured within the standard industry measurement tolerances. Product image colours will be affected by your monitor and by your printer and therefore may not be 100% accurate to the finished product. The colour of the shed can also vary in different lighting and weather conditions. Exposure to sunlight can also change the colour of the shed. Occasionally due to factors beyond our control there may be some visible shrinkage in the timber. We reserve the right to supply goods with minor differences in specification due to circumstances beyond our reasonable control. Should this be the case any differences will result in the goods being of an equal or improved standard, and it will not affect your rights under the law, and the quality coding and guarantee will continue to apply.
Pricing
All prices shown on our website are in GBP£ and are inclusive of VAT at the current rate, where applicable. The prices stated on the order page when you placed your order are the final prices. They include all price components including all applicable taxes.
Payment
We accept payment by Bank transfer, Cash and credit or debit cards registered to the UK. We accept the following cards: Maestro, Visa Debit, Visa Electron, MasterCard, Solo and Visa Credit. To ensure that your credit or debit card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. Payment can be received in full on the day of purchase or an agreed deposit taken (Usually 50% of total cost). The remaining balance must be paid on delivery prior to installation. Where the finance option has been taken the deposit will be stated at the time of application.
Finance
In certain circumstances, we can offer you finance options via a third party. In this event we will provide you with the details on our website to begin the application. If you begin the application process a separate contractual relationship will be created between you and the financial provider (Subject to additional terms and conditions) and we cannot be held liable for any errors, actions, omissions or incorrect charges they make.
Delivery & Installation
For Woodpecker Garden Buildings to be able to confirm your order, you must first provide proof of adequate access to the grounds on which the garden building will be erected. All garden buildings must be assembled on a firm and level base to ensure a good foundation and to maximise shed longevity. It is the customer’s responsibility to ensure such a base is installed prior to Woodpecker Garden Buildings commencing with installation. Failure to ensure a suitable base may result in an aborted visit.
We will aim to deliver the product(s) to you within the turnaround time we have specified to you when placing your order. If you have provided us with a mobile number, we will aim to contact you the week of the delivery to arrange an approximate date and time slot. In the case of the non-availability of goods, a possible advance payment will be refunded without delay. All deliveries must be signed for (Pre COVID-19). If we are unable to deliver but arrived on the day you selected and in the two-hour time slot we advised but there is nobody in, then we would have to take the package away and there may be re-delivery charges / fees.
If we are unable to complete the delivery & installation due to reasons out of our control such as, unsuitable base for the garden building or lack of access to the area we would have to take the package away and there may be re-delivery charges / fees.
It is not possible for us to quote on electric runs from the fuse board of the main house to the garden building. All of our customers are made aware of this at the quoting stage and it is the customers responsibility to ensure that the armoured cable is run prior to us installing on the day.
Your Rights
You have the right to cancel this contract within 14 days without giving any reason. The cooling off period will expire after 14 days from the day of purchase, which includes a deposit being received. To exercise the right to cancel, you must inform us in writing by emailing us at customerservices@woodpeckergardenbuildings.co.uk
After the 14 day cooling off period, the item will be deemed as being in production and we are unable to cancel the order. Even if the item is no longer required after the 14 day period, payment will be due in full no later than 8 weeks after the purchase was made.
Any Issues with the Product
We are under a legal duty to supply products that are in conformity with this contract. Nothing in these terms will affect your legal rights. The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:
- Up to 14 days: if your goods are faulty, our team are on hand and available to assist you, and fix any faults without charge.
- Up to 12 months: if your goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.
If you wish to exercise your legal rights to reject products you must either return them to us or allow us to collect them from you.
As a general rule, our products all come with a 12 month parts guarantee as standard. If products come with an extended guarantee this is stated on each product page. Where no guarantee statement exists, the 12 month period applies. Wherever an item has failed to live up to expectations, we will first repair to make as new where possible. If this cannot be done we will replace the faulty item with new. Should you have any guarantee questions relating to a product pre-order, please contact us for assistance.
Data Protection
We are a registered data controller for the purposes of the Data Protection Act 1998 (the “Act”) and we will comply with the statutory requirements imposed on us to keep your personal data confidential and secure. We are fully compliant with the Act. Your information (or the information of the nominated adult) will be used to process your Order, deliver your Goods and/or to handle any claims made under the guarantee.
